Terms of Service

1. OHENRY PRODUCTIONS MAKES NO CLAIM TO YOUR WORK.

By submitting your materials, you waive your rights to pursue legal action against OHenry Productions should a similar but different project be produced.

2. OHenry Productions and/or affiliates, provides subjective opinions on your literary work at your request, and will provide subjective, (non-objective) criticism of your submitted work as pertains to character, plot, story, setting, tone, format, and other categories. Clients submitting literary materials to us for services agree that in any literary work there are countless details regarding character, plot, story, setting, tone, format, etc. and that it is physically and humanly impossible for any person or service to comprehend, interpret, and/or critique them all, point-by-point.

3. You agree that we reserve the right to set the scale and scope of their focus on said details based on the level of service ordered. Further, we are under no obligation to “understand your work” based on terms defined by you, the client. Nor are we are under any obligation to “get the story facts right” in a manner determined by you.

4. You the client agree to hold OHenry Productions not responsible for any details in your story that the reader may have commented on which you believe to be inaccurate.

5. You understand that you are not entitled to a refund of any kind just because you disagree with the reader’s opinion, or because you believe details in your submitted work were inaccurately commented upon.

6. We respect your privacy and permits you to control the treatment of your personal information. No dissemination of your personal information or work to any third parties will take place.

7. We are not responsible for your submitted works. We will not disseminate your works in any manner. You are responsible for maintaining the master copy of your submitted works. You agree to hold OHenry Productions harmless in the event we lose your submitted works for any reason.

8. You understand that our promised turnaround time is approximate. You understand that there is no guarantee that you will receive your script coverage within the turnaround time.

9. All follow-up questions must be sent in within 5 days of our delivery of your coverage/notes.

You expressly understand and agree that OHenry Productions and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors shall not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (regardless of whether OHenry Productions has been advised of the possibility of such damages), resulting from:

(i) The use or the inability to use the OHenry Productions script coverage service;

(ii) The cost of the procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the OHenry Productions script coverage service; or

(iii) Any other matter(s) relating to the OHenry Productions script coverage service.
